    they have already started the ball rolling and contacted people and I doubt it's going to stop, there's pressure on jagex by players to put a stop to the integrity issues (gold sites, botting, buying services, rsps, third-party clients)

    The gold farming is insane. I'm convinced there are more gold farmers than actual players at this point.

    Legally, every item in RuneScape is the property of Jagex, and therefore cannot be considered as personal property of the player. Players who conduct RWT violate rule 12, and risk being permanently banned without warning.
    I think this is bullshit. If we have earned the item and spent out fucking time getting items and revised the game enough to flip etc we should be able to do what the fuck we want with the items.

    I'd love to know what case law they have to support this as a legal position. It might not be in the spirit of the game but seems a bit far to say that a virtual item that a player has worked very hard for is not legal to be sold for real world currency.

    so they no longer focus on RSPS .. Just wanted to know if others have heard about the settlement agreement, how true it is?

    Your guess is as good as ours. Looks real enough but I doubt they intended to actually use it in that case considering the owner was a minor. Probably just wanted to scare the kid by writing a stern email to his parents. I cannot name a single instance of anyone being taken to an actual courtroom. Out of court settlements are more difficult to discern. Some servers have been shutdown but I do not know the extent of that. By that I mean I do not know if they just received threats or were taken to court and ordered to close by an actual injunction of sorts or if they had their assets frozen. Given the nature there may have been a few court cases that have not had any publicity because doing so would alert the wider runescape playerbase to their existence. All speculation really.

    It's not bullshit. It's their property. You aren't paying for property ownership you're paying a membership fee for access to the game. You don't legally own a random bit of data in their database.

    It's their game, they define the terms of service. They can freely deny you service. You have no legal right to access the items on your account, and that data belongs to jagex not any player.

    The 'legal right' is what interests me. I know it is against the terms of service, but I would be interested in whether these arguments have ever been in an actual courtroom. The sale of virtual items by gold companies is a lot clearer (not only does it violate TOS but it unjustly enriches the company benefiting from exploiting the TOS), but what about an actual player who has put so much time and labour into it? What I mean is just because the company does not want you to do something does not necessarily mean it is illegal. Think about us with reverse engineering and fair use.

    Jagex legally can't do anything as long as you're not redistributing any of their software/data. Most servers do. Otherwise you could be sued quite easily if they wanted to. There are ways around this. But that's why some owners received a cease and desist. That also goes for donation shops. You can't legally sell any virtual items for real $ even on your private server. It doesn't matter if it's custom models/animations/etc you created. You can however receive donation money to pay to keep the server up.
