There are probably hundreds of companies and/or trademarks with a common, human name within. It's no big deal. This is also because you cannot file a copyright complaint on a person's name; you could name your kid Jagex or RuneScape (the poor child) and it wouldn't be a problem.
The possibility to copyright a name is based on the name itself.




If Jagex REALLY wants to shut you down, they will. You must consider that there are numerous reasons that Jagex "allows" private servers to exist (a few I can name):
- Going after all of them would require time (and in the business world, time is generally equal to money, so transitively, going after all of them would require money)
- Features on the servers can provide Jagex with great insight as to what to add to their own game
- The lack of quality that the servers possess (I hate to be brutally honest, but let's face it, I don't think that there are any servers that are coded "better" overall than Runescape, please prove me wrong if you can [Yes, I realize other servers are more fun, but fun is completely a matter of opinion {I do suppose that "better" is a matter of opinion too, but it is generally far more consistent from person to person than fun}]) will subtly encourage players to sway towards playing the "real thing" because they find it more fun.
- Private servers can get a person that has completely lost interest in Runescape to come back to the Runescape scene, and as mentioned above, they will probably wind up going back to Jagex's site at one point or another).

Clients are illegal because they aren't our work, servers are our work besides a small part.

The short answer is to simply say that names, titles, short phrases, (and also colours), are not considered unique or substantial enough to be awarded copyright protection in their own right, but as this is such a common question, it is perhaps worth explaining the logic behind this.
