    setCookie("tos", null, time() - 3600);
    why not just
    setCookie("tos", null, 0);

    why do you need to take the current time and go an hour back? It's like you don't even know what you are doing.

    good job,
    but lets take for an example.

    You made a homepage yourself in php.
    its the index.php

    you require the check.php which sould redirect you to your homepage.
    but your homepage is index.php
    This sould mean that it will keep redirecting edless and do nothing else.

    or am i saying something stupid?

    You do know that the Terms of Service applies to all users, ones visiting the site and ones registered, if you put it that they have read it when they register, then you're set, there is no need to force users to agree to this, when they already are when visiting your site.
